This document containing terms and conditions of use (“Terms and Conditions”) is an ‘electronic record’ in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures for its execution.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and terms and conditions of use for access or usage of the www.propsurf.com website (the “Site”) or the PropSurf mobile application (the “Application”).

The Site and the Application shall hereinafter be collectively referred to as “PropSurf


  2. PropSurf may amend/modify these Terms and Conditions at any time, and such modifications shall be effective immediately upon posting of the modified Terms and Conditions on PropSurf. You may review the modified Terms and Conditions periodically to be aware of such modifications and your continued access or use of PropSurf, shall be deemed conclusive proof of your acceptance of these Terms and Conditions, as amended/modified from time to time. PropSurf may also suspend the operation of PropSurf for support or technical upgrades, maintenance work or for any other reason.

    If you utilize PropSurf in a manner inconsistent with these Terms and Conditions, PropSurf may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse may be deemed to be fit and proper.

  3. These Terms and Conditions apply to all users of PropSurf, whether registered, unregistered, accessing any type of content provided on PropSurf.

  4. Definitions

    The term 'Registered Member' would include any person, whether an individual or a legal entity who has subscribed to the services of PropSurf, and to whom the access is restricted by the use of a sign in user name and a password. The user name and password are either allotted by PropSurf or chosen by the Member or agreed upon by PropSurf.

    The terms “Service” or “Services” would mean to include the interactive online information service offered by PropSurf on the internet through which the user may access information carried by PropSurf in the database maintained by it. The terms would include the search tools through which the user can search through the hosted databases and information using a number of search tools that are present with a selection matching their search criteria. Users then select one or more of the items presented to view the full document / record. The term Service also extends to any offline activity or service PropSurf may engage in, which shall essentially be related to the real estate sector. This may include (but not be limited to) activities such as advertisements, promotions, transactional and financial support, liasoning and any other services related to the real estate sector / industry.

  5. Membership Eligibility

    Use of PropSurf is available only to persons competent to contract under the Indian Contract Act, 1872. Persons who are not competent tocontract within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use PropSurf. If you are a minor i.e. under the age of 18 years, you shall not register as a Member of PropSurf. As a minor if you wish to use PropSurf, such use or transaction may be undertaken by your legal guardian or parents on PropSurf. PropSurf reserves the right to terminate your membership and / or refuse to provide you with access to PropSurf if it is brought to PropSurf’s notice or if it is discovered that you are under the age of 18 years.

  6. Proprietary Rights

    You acknowledge and agree that PropSurf and any necessary software used in connection with PropSurf contains proprietary and confidential information of PropSurf and third parties that is protected by applicable intellectual property rights and other laws. You further acknowledge and agree that advertisements or information presented to you through PropSurf or by advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly permitted by applicable law or as authorized by these Terms and Conditions or the applicable licensor (such as an advertiser), you agree not to modify, rent, lease, loan, sell, distribute, transmit, broadcast, publicly perform, publicly display, or create derivative works based on the material on PropSurf, in whole or in part.In addition to the above, you may only view, copy and print portions of the Content (as defined below) for your own informational, personal and non-commercial use. Further, you may not use any data mining, robots or similar data gathering or extraction methods for any purpose on PropSurf.

    Intellectual property of PropSurf used on PropSurf are protected under applicable laws. As such, they are strictly the property of PropSurf and third parties are not allowed to use them until and unless PropSurf provides a written approval.

    Pictures, photos, graphic charts, texts, floor plans, survey maps and any other data published on PropSurf which is owned by PropSurf may be used / altered / transferred / reproduced only with prior written approval from PropSurf.

    Other product names, logos, brands, and trademarks, floor plans, still renders, survey maps etc, (whether registered or unregistered) that are featured or referred to on PropSurf are the sole and exclusive property of their respective trademark holders. You are not permitted to use / alter / transfer / reproduce such Content. PropSurf shall not be liable in any manner for your usage / alteration / transfer / reproduction of such Content

  7. Hyperlinks

    You are granted a limited, non-exclusive right to create a text hyperlink to PropSurf for non-commercial purposes, provided such link does not portray PropSurf or any of its products or services in a false, misleading, derogatory or otherwise defamatory manner and provided further that the linking website or application does not contain any adult or illegal material or any material that is offensive, harassing or otherwise objectionable. PropSurf may revoke this limited right at any time. You may not use a PropSurf logo or other proprietary graphic of PropSurf to link to PropSurf without the express written permission of PropSurf. Nothing contained on PropSurf may be construed as granting, by implication, estoppel or otherwise, any license or right to use any patent, trademark, copyright or other proprietary right of PropSurf or any third party without the prior written permission of PropSurf or such other party that may own such patent, trademark, copyright or other proprietary right(s).

    PropSurf may contain links to third-party websites or applications ("Third-Party Domains") and third-party content ("Third-Party Content") as a Service to those interested in this information. You use links to Third-Party Domains, and any Third-Party Content therein, at your own risk. PropSurf does not monitor or have any control over, and makes no claim or representation regarding Third-Party Content or Third-Party Domains. PropSurf provides these links only as a convenience, and a link to a Third-Party Domains or Third-Party Content does not imply PropSurf's endorsement, adoption or sponsorship of, or affiliation with, such Third-Party Domain or Third-Party Content. PropSurf accepts no responsibility for reviewing changes or updates to, or the quality, content, policies, nature or reliability of, Third-Party Content, Third-Party Domains linking to PropSurf. When you leave PropSurf, our terms and policies no longer govern. You should review applicable terms and policies, including privacy and data gathering practices, of any Third-Party Domain, and should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any third party.

  8. Use of Chat Rooms, Bulletin Boards and Other Interactive Areas

    PropSurf may contain discussion forums, bulletin boards, review services or other forums in which you or third parties may post content, messages, materials or other items on PropSurf ("Interactive Areas"). If PropSurf provides such Interactive Areas, you are solely responsible for your use of such Interactive Areas and use them at your own risk. Further, by using any Interactive Areas, you expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through PropSurf any of the following:

    1. Any message, data, information, text, music, sound, photos, graphics, code or other material ("Content") that is unlawful, libellous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;

    2. Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law, including, without limitation, the regulations of the Securities and Exchange Board of India or any rules of a securities exchange where the shares of the concerned entity have been listed such as the National Stock Exchange and the Bombay Stock Exchange;

    3. Content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;

    4. Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;

    5. Unsolicited promotions, political campaigning, advertising or solicitations;

    6. Private information of any third party, including, without limitation, addresses, phone numbers, email addresses, social security numbers and credit card numbers;

    7. Viruses, corrupted data or other harmful, disruptive or destructive files. By breaching this clause you will committing a criminal offence under the Information Technology Act, 2000 (along with all amendments thereto), and in such an instance we will be disclosing your information to law enforcement officials and you will not be permitted to use PropSurf.

    8. Content that is unrelated to the topic of the Interactive Areas in which such Content is posted;

    9. Content that, in the sole judgment of PropSurf, is objectionable or which restricts or inhibits any other person from using or enjoying the Interactive Areas or PropSurf, or which may expose PropSurf or its affiliates or its users to any harm or liability of any type.

    10. Material that is knowingly false, misleading, or inaccurate. You will not solicit Personal Information (as defined under our Privacy Policy) from any member. You will not use information gathered from PropSurf to harass, abuse or harm other people.

    11. Engage in politically-charged rhetoric, politically-inspired name-calling, and related right-versus-left political bickering while posting in any topical forum or discussion thread on PropSurf.

    12. Post identical content, or snippets of identical content, to multiple threads in the discussion forums. You will not create more than one thread for your topic, or create multiple "slightly different" threads for a single topic.

    13. The dominant language of our users and moderation staff is English. In order to promote a smooth-running environment and fair enforcement of the Terms and Conditions, you agree not to post in any language other than English.

    14. You will not create multiple user accounts

    15. You will not engage in an organized collaboration with other members to disrupt thread topics or interrupt the flow of normal collaborative discussion. Doing so will result in removal of your post(s) and immediate termination of your account.

    16. You may not use PropSurf to transmit or reproduce someone else's intellectual property. For example, you may not use the message boards, bulletin boards or notice boards to post reviews from someone else's blog or guide, because that could violate the author's or publisher's copyright rights. 

    PropSurf takes no responsibility and assumes no liability for any Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto, nor is PropSurf liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. As a provider of interactive services, PropSurf is not liable for any statements, representations or Content provided by its users in any Interactive Area or other public forum. Although PropSurf has no obligation to screen, edit or monitor any of the Content posted to or distributed through any Interactive Area, PropSurf reserves the right, and has absolute discretion, to remove, screen or edit without notice any Content posted or stored on PropSurf at any time and for any reason, and you are solely responsible for creating backup copies of and replacing any Content you post or store on the PropSurf at your sole cost and expense.

    Any use of the Interactive Areas or other portions of PropSurf in violation of the foregoing violates these Terms and Conditions and may result in, among other things, termination or suspension of your rights to use the Interactive Areas and/or PropSurf.

    Notwithstanding the above, PropSurf reserves the right to refuse access to the Services offered under this site to new users, or to prevent access to existing users at any time, without according any reasons for doing so.

    If you find any content to be offensive or threatening, please contact support@propsurf.com with details of the same. If we determine (at our sole discretion) that removal of a post or posts is necessary, we will make reasonable efforts to do so in a timely manner. PropSurf will make every effort to provide a free and open discussion environment within the boundaries of these Terms and Conditions that does not contain offensive or threatening messages, but cannot guarantee that all such messages will be found and removed within any specific time frame.

  9. Rights to User Content

    Content submitted by users will be considered non-confidential and PropSurf is under no obligation to treat such Content as proprietary information. Notwithstanding the foregoing, PropSurf reserves the right to use the Content as it deems appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. PropSurf is under no obligation to offer you any payment for Content that you submit or the opportunity to edit, delete or otherwise modify Content once it has been submitted to PropSurf. PropSurf shall have no duty to attribute authorship of Content to you, and shall not be obligated to enforce any form of attribution by third parties.

    With regard to the Content, you hereby declare that (a) you do not require that any Personal Information be used in connection with the Content, or any derivative works of or upgrades or updates thereto; (b) you have no objection to the publication, use, modification, deletion and exploitation of the Content by PropSurf or its licensees, successors and assigns; (c) you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of the Content; and (d) you forever release PropSurf, and its licensees, successors and assigns, from any claims that you could otherwise assert against PropSurf by virtue of any such moral rights.

  10. Privacy Policy

    Please refer to PropSurf’s Privacy Policy for information on how PropSurf collects, uses and discloses Personal Information from its users.

  11. Advertisements and Promotions

    PropSurf may run advertisements and promotions from third parties. Your business dealings or correspondence with, or participation in promotions of, such advertisers other than PropSurf, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. PropSurf is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third-party advertisers on PropSurf.

  12. Copyright Complaint Policy

    If you believe in good faith that materials hosted by PropSurf infringe your copyright, please provide the written information requested below. The procedure outlined below is exclusively for notifying PropSurf that your copyrighted material has been infringed.

    Please provide the following information in the format below:

    1. A clear identification of the copyrighted work you claim was infringed.

    2. A clear identification of the material you claim is infringing the copyrighted work, and information that will allow us to locate that material on PropSurf, such as a link to the infringing material.

    3. Your contact information so that we can reply to your complaint, preferably including an email address and telephone number.

    4. Include the following statement: "I have a good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law."

    5. The notice must be signed by the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

    6. Notices of claims of copyright infringement on PropSurf should be emailed or mailed to support@propsurf.com

    We suggest that you consult your legal advisor before filing a notice or counter-notice. Also, please note that you may be liable for damages (including costs and attorneys fees) if you make a false claim of copyright infringement.

    We will review and address all notices that comply with the requirements above

  13. Indemnity

    You are and shall remain solely responsible for the content of any comments you make and you agree to indemnify us and our affiliates for all claims resulting from any Content you submit. We and our affiliates take no responsibility and assume no liability for any comments submitted by you or any third party.  

    You agree to defend, indemnify and hold and our employees, directors, officers, agents and their successors and assigns harmless from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to us or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under these Terms and Conditions or arising out of the your violation of any applicable laws, regulations including but not limited to intellectual property rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of these Terms and Conditions.

  14. Registration Data and Account Security

    You agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on PropSurf ("Registration Data"); (b) maintain the security of your password; (c) maintain and promptly update the Registration Data, and any other information you provide to PropSurf, and to keep it accurate, current and complete; and (d) accept all risks of unauthorized access to the Registration Data and any other information you provide to PropSurf.

  15. Limitation of Liability


  16. Governing Law and Jurisdiction

    These Terms and Conditions and the PropSurf Privacy Policy shall be governed by and construed in accordance with the laws of India. Courts at Mumbai shall have exclusive jurisdiction to try any disputes under these Terms and Conditions or the Privacy Policy.

    With regard to disputes between users of PropSurf, PropSurf reserves the right but not the obligation to monitor disputes between two users or Members.

  17. Termination/Modification of License and PropSurf Offerings

    Notwithstanding any provision of these Terms and Conditions, PropSurf reserves the right, without notice and in its sole discretion, without any notice or liability to you, to (a) terminate your license to use PropSurf, or any portion thereof; (b) block or prevent your future access to and use of all or any portion of PropSurf (c) change, suspend or discontinue any aspect of PropSurf (d) impose limits on the usage of PropSurf.

  18. Severability

    If any provision of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

  19. Advertising

    You will not advertise or promote other discussion boards, chat systems, online communities or other websites on PropSurf within posts, private messages, avatars and/or signatures without prior written permission from PropSurf. You will not choose a username that is the same as a website domain, subdomain, or URL for which you are associated

  20. Unauthorized Access

    You will not attempt to access any protected sections of the PropSurf, or make use of any hacks, cracks, bug exploits, etc. to bypass or modify the features of the Interactive Areas or to obtain information beyond the allowed features of your account status. Doing so will result in immediate termination of your account.

  21. Disclosure

    PropSurf also reserves the right to disclose any known Personal Information when required by law or in the good-faith belief that such action is necessary to conform to the law or comply with a legal process served on PropSurf, protect and defend the rights or property of the PropSurf domains, or visitors to these domains, identify persons who may be violating the law, the legal notice, or the rights of third parties, and cooperate with the investigations of purported unlawful activities.

  22. No Guarantee

    PropSurf makes no claim or warranty, implied or otherwise, that guarantees the availability of the free services offered under its domains; including, but not limited to, games, contests, special events/content, chat, and discussion threads.

  23. E-mail Updates:

    In order to provide our services, we may need to communicate with you via e-mail. You agree to receive e-mails which are specific to your account and necessary for the normal functioning of PropSurf, including one or more welcome e-mails which help inform new users about various features of the PropSurf

    We may also send occasional e-mail bulletins encouraging users to log in to PropSurf or take advantage of various features or offers, unless you have opted not to receive these e-mails. PropSurf does not take any responsibility of the validity of any of these offers. You will be able to opt in or out of some of these e-mails by updating your preferences through your “Manage Account” page.

  24. Grant of Rights to PropSurf

    We take the privacy of our users very seriously. However PropSurf will have a right to use Personal Information to provide personalized advertisements and offers and to include such PersonalInformation in compilations developed by PropSurf, or to develop derivative works based on that information. 

    You, as a subscriber/ user of the services offered byPropSurf, do herby expressly authorize PropSurf and any of our business associates (or any other third parties that may be associated with PropSurf) to call/ SMS your registered phone numbers (as provided by you to PropSurf). You hereby expressly state that such authorization shall override the national Do-Not-Disturb Registry (“DND”), even if the phone numbers in question are registered under DND list of national Consumer preference registry (NCPR/NDNC).

    You also undertake that you will not make any complaints to NDNC for any calls received from PropSurf services/ products, and shall indemnify PropSurf and any of its business associates for having engaged in any such practice. You hereby authorize PropSurf and its business associates to continue contacting you via any of the modes of communication listed above, till such time as you expressly opt-out / unsubscribe from the service offered by PropSurf. Till such time, PropSurf and its business associates shall have all rights to continue communicating with you and you shall completely indemnify them against any liability that may arise as a result of such authorization to communicate. Such indemnification shall extend to court cases and suits and all lawyer/ advocate fees.
